1. Agreement to Terms

By accessing or using FullyAlive ("we," "our," or "us"), including our website, mobile application, and services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service.

These Terms constitute a legally binding agreement between you and FullyAlive. We reserve the right to modify these Terms at any time, and such modifications shall be effective immediately upon posting. Your continued use of the Service after any such modifications constitutes your acceptance of the modified Terms.

2. Eligibility

You must be at least 18 years old to use the Service. By using the Service, you represent and warrant that:

  • You are at least 18 years of age
  • You have the legal capacity to enter into these Terms
  • You will comply with all applicable laws and regulations
  • All information you provide is accurate and truthful

3. Account Registration

To access certain features of the Service, you must register for an account. You agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain and update your account information to keep it accurate
  • Maintain the security of your password and account
  • Accept responsibility for all activities that occur under your account
  • Notify us immediately of any unauthorized use of your account

You are responsible for maintaining the confidentiality of your account credentials. We are not liable for any loss or damage arising from your failure to protect your account information.

4. Subscription Terms

4.1 Free Trial

New users are eligible for a one-time 5-day free trial period. During the trial, you have full access to all premium features. The trial begins immediately upon activation and cannot be paused, extended, or restarted.

Important: If you do not cancel before the trial ends, your subscription will automatically convert to a paid subscription, and you will be charged according to your selected plan.

4.2 Subscription Plans

We offer the following subscription plans:

  • Monthly Plan: $7.00 USD per month, billed monthly
  • Yearly Plan: $60.00 USD per year, billed annually (equivalent to $5.00 per month)

All prices are in USD and are subject to change. We will notify you of any price changes at least 30 days in advance. Price changes will apply to your next billing cycle.

4.3 Billing and Payment

  • Subscriptions are billed in advance on a recurring basis
  • Payments are processed securely through Stripe
  • You authorize us to charge your payment method for all subscription fees
  • If payment fails, we may suspend or terminate your subscription
  • You are responsible for all applicable taxes

4.4 Automatic Renewal

Your subscription will automatically renew at the end of each billing period unless you cancel before the renewal date. You can cancel your subscription at any time through your account settings or by contacting support.

4.5 Cancellation

You may cancel your subscription at any time. Cancellation takes effect at the end of your current billing period. You will continue to have access to premium features until the end of the period you have already paid for.

To cancel, visit your account settings or contact us at support@fullyalive.app. Cancellation requests must be submitted at least 24 hours before your next billing date to avoid being charged for the next period.

5. Refund Policy

ALL SALES ARE FINAL. NO REFUNDS WILL BE PROVIDED FOR ANY SUBSCRIPTION FEES, INCLUDING BUT NOT LIMITED TO:

  • Monthly or yearly subscription fees
  • Fees charged after the free trial period
  • Fees for unused portions of subscription periods
  • Fees charged due to failure to cancel before renewal

By purchasing a subscription, you acknowledge and agree that you will not receive a refund for any reason, including but not limited to:

  • Dissatisfaction with the Service
  • Technical issues or service interruptions
  • Failure to use the Service
  • Account suspension or termination for violation of these Terms
  • Changes to the Service or features

Exception: In the event of a technical error on our part that results in duplicate charges, we will refund the duplicate charge. All other charges are non-refundable.

6. User Conduct

You agree not to:

  • Use the Service for any illegal purpose or in violation of any laws
  • Violate or infringe upon the rights of others, including intellectual property rights
  • Harass, abuse, threaten, or harm other users
  • Post, upload, or transmit any content that is:
    • Defamatory, libelous, or false
    • Obscene, pornographic, or sexually explicit
    • Hateful, discriminatory, or offensive
    • Violent or threatening
    • Spam, unsolicited, or promotional
    • Contains viruses, malware, or harmful code
  • Impersonate any person or entity or misrepresent your affiliation
  • Attempt to gain unauthorized access to the Service or other users' accounts
  • Interfere with or disrupt the Service or servers
  • Use automated systems (bots, scrapers) to access the Service
  • Reverse engineer, decompile, or disassemble any part of the Service
  • Share your account credentials with others
  • Create multiple accounts to circumvent subscription requirements

7. Content and Intellectual Property

7.1 Your Content

You retain ownership of any content you create, upload, or post to the Service ("Your Content"). By posting Your Content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and distribute Your Content solely for the purpose of providing and improving the Service.

You are solely responsible for Your Content and represent that you have all necessary rights to post it.

7.2 Our Content

The Service, including all text, graphics, logos, software, and other content, is owned by FullyAlive or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without our express written permission.

8. Service Availability

We strive to provide continuous access to the Service, but we do not guarantee that the Service will be available at all times. The Service may be unavailable due to:

  • Scheduled maintenance
  • Technical issues or failures
  • Force majeure events
  • Third-party service outages

We are not liable for any loss or damage resulting from Service unavailability. We reserve the right to modify, suspend, or discontinue any part of the Service at any time with or without notice.

9. Account Suspension and Termination

We reserve the right to suspend or terminate your account immediately, without prior notice or refund, if you:

  • Violate these Terms of Service
  • Engage in fraudulent, illegal, or harmful activity
  • Abuse or harass other users
  • Attempt to circumvent subscription requirements
  • Use the Service in a manner that could damage our reputation or business

Upon termination, your right to use the Service will immediately cease. We may delete your account and all associated data. We are not obligated to provide you with a copy of your data upon termination.

You may terminate your account at any time by contacting support@fullyalive.app or deleting your account through the Service.

10. Disclaimers and Limitations of Liability

10.1 Service Provided "As Is"

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

10.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FULLYALIVE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

  • Your use or inability to use the Service
  • Any unauthorized access to or use of our servers or data
  • Any interruption or cessation of transmission to or from the Service
  • Any bugs, viruses, or other harmful code transmitted through the Service
  • Any errors or omissions in any content or for any loss or damage incurred as a result of the use of any content

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE USE OF OR INABILITY TO USE THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRIOR TO THE CLAIM, OR $50, WHICHEVER IS GREATER.

10.3 No Medical or Professional Advice

The Service provides support and resources for addiction recovery but does not provide medical, psychological, or professional advice. The Service is not a substitute for professional medical or mental health treatment. Always seek the advice of qualified health providers with any questions you may have regarding a medical or mental health condition.

11. Indemnification

You agree to indemnify, defend, and hold harmless FullyAlive, its officers, directors, employees, and agents from and against any claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including attorney's fees) arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Any content you post or transmit through the Service

12. Dispute Resolution

Any disputes arising out of or relating to these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. You waive your right to a jury trial and to participate in a class action lawsuit.
